Picture an upside down pyramid from the start of the case to the end. Their window opportunity becomes less and less with the loss of each filing. Then it is over, nowhere to go. K&L is at that point now. A reversal of fortune is highly unlikely, and they know it. As to the filing, give it a few days, that is if they filed at all. If they have malpractice insurance, they have to show their insurer they did everything possible to conclude this matter in their favor. Their burden to show that they deserve relief is extremely heavy. Too many judges have already ruled against them. Quantum, at this point, is in sitting in a very good place legally.
