I have seen that many times in the past (although not listed in the trial protocol).
I have discussed it with many board members many times in the past.
And, I have been operating under that assumption up until yesterday.
In the big picture, there's way too much misspeaking going on here. A clear, concise, disciplined recitation of facts is how public companies disclose information to their stockholders.
That approach is not only deserved by shareholders -- it will be demanded by institutions.
Unpacking details provided in conference calls has become somewhat of a cottage industry.
