I trust you on your word. My bank/broker though specifically warns for it that you've lost your legal ownership if you decide to accomadate others to short. Without a doubt our legislators forced them into warning people for those consequences.

Every jurisdiction follows it's own rules but often they're comparable.
Hence my warning.
If losing legal ownership is not a US thing than it's most likely something EU residents should take into account.
