It appears that the ban is for prophylactic use only. The drug may be used with patients suffering with COVID-19 in the FDA approved trials, Concern being that there be sufficient supply available for those using it for autoimmune and anti-malarial indications.
This action is also being taken in a number of other states, not just NY.

Yes, providers generally have a right to use an approved medication for an off-label use but also have to be responsible about such use. Unfortunately, it appears that too many providers in NY have not been that responsible.
