Most of what I offered re Thriftycents concerns was first year contract law hornbook material. Yes, a breach of a warranty can occur without it being a material breach, but if it's not material, recission would not be a viable remedy. I was responding only to the the one sentence cited by Thrifycents. Naturally, access to the entire contract would be necessary for a comprehensive review.

Drawing contracts was not my primary area of practice, but construing, drafting, and modifying contracts often came into play. If the advice I provided wasn't helpful, ignore it.
