I’m not 100% whether or not this buy would be illegal insider trading, but I think a key point is he participated at the same time and terms as others. If trading open market (unannounced/unscheduled), on different/better terms and/or a separate time and offering than other external it would likely be viewed different in the eyes of the SEC.
