“Platinum's biggest fear is that they or J&J will settle with DECN, goves him a bunch of money, and he decides to use it to build the company, not reward thankless shareholders. And then KB comes back and says, "OK I have enough money to do GenUltimate TBG on our own. Platinum, a new Sheriff is in town."
Serious? We have heard that the company needs a partner. We have heard that a licensing agreement with a “chosen” partner has commenced. Should not the licensing agreement finalize very quickly and well before end of year? I’m no insider but no way would Platinum settle without reassurance that GenUltTBG is in their stable. KB would be foolish not to get his license agreement behind him ASAP and not risk a ruling. Also, even a DECN win could drag for years. That is just the way J&J and other blue bloods work.
IMHO, KB needs to take a conservative can-do approach. If the sentiment is a DECN court victory, Platinum should be motivated and incentivized to settle the royalty arrangement quickly. Strike.
The risk of not doing anything and playing with fire is certainly not an approach that would or should go over in any boardroom. As a shareholder, I would not be in favor of delaying any agreement that helps capitalize the company. Fiduciary responsibility.
