In thinking about it, I don’t see how any of the parties would feel comfortable letting the judges decide on this as opposed to making a strong effort to getting this settled and put to bed.

J&J still thinks they are going to win. They are just much less sure about it since DECN wasn't laughed out of court. It is hard to fathom the concept and the levels of J&J arrogance.
