Izatt raised it based on March, 2017 OTP announcement. From Manuel's affidavit, page 188;

(d) Not withstanding the foregoing, and for the sake of argument, Ucore notes that the identification of the SuperLig(R) name as a U.S. registered mark is added for clarity, since this mark is registered only in the U.S.. There is no application or registration for such a mark in Canada, or with respect to websites domiciled therein, or electronic communications or print materials originating therefrom".
