Agreed! But as I said in my response to NPike, I think his analogy makes sense

Why keep legal resources tied up in an inadequate legal system currently. Wait for their new patents, and hopefully positive results from Congress before allocating your resources. IMHO there will not be a shortage of other infringers to pursue in a more favorable legal environment.
