The judge panels usually decide appeals that are not particularly well based on rules of patent law very quickly, usually within 10 days of the hearing. So, I am thinking that if DECN did not make a particularly well founded appeal based on the rules of patent law, I think the chances of a Rule 36 become minute by next Monday, even perhaps Friday. But with this week having Yom Kippur I think we wait until next Monday. But, by tomorrow if no Rule 36 entry, I will say the chances of the case progressing to a ruling will be at 97% to 98%. By Monday, IMO, 99.71%.
