No Rule 36 doesn't bode well for them. I would imagine once another week or so goes by without a Rule 36, they'll start to shift to the next strategy (settlement discussions?).


It is clear from the abbreviated presentation put on by Lifescan that they believed going in that they had it in the bag. It is not certain yet, but it appears that this strategy may have boomeranged.
