5 more Rule 36s posted by the Court today--none were Pharmtech/DECN.
The five cases that were kicked were from two other panels, one panel from October 2, the other panel from October 3. The October 3 panel had mostly the same panel judges as DECN. Both of these panels were further down the list of panel hearings, beneath DECN's case against J&J. I am thinking that DECN's jeopardy to a Rule 36 is going down fast, as Sensi said it would. IMO we'll be over 90% if nothing is posted tomorrow.
