I entirely agree with the writer - that the judges should think and decide cases independently. But he's expecting the Federal Circuit Court to act independently from the Supreme Court decision of Alice 101 and it won't.

Alice 101 and "abstract idea" are referenced throughout the article for most patent cases being decided to be patent ineligible. You can thank the Supreme Court for that - not the Federal Circuit Court. That's what happened in our case.

The author can write all the articles he wants complaining about the Federal Circuit Court (just like we complained about their decision in our case) but until the Supreme Court revisits its ridiculous decision and fixes it or Congress passes legislation correcting it, there's not much that can be done - whether the author (or we) like it or not.
