Welcome to the board LACYDY. If the financing is through Paulson, I suspect it would be on the terms similar to the last raise, 40c + warrants. They big selling with nite and etrade in the past has come with similar raises, probably people selling say shares at 38-39c to exchange for 40c shares+warrants. It makes sense to sell in that situation, even if you are expecting a sp increase very soon, because you are gaining total shares by selling to fund the purchase.
That is why I liked the TO this summer, they were giving up warrants, so the free perk was gone, you are adding risk instead of reducing it. And most warrants exchanged was gotten through buying 75c or $1 shares; who would sell at 35c, if the TO drops your average to 45c? Makes no sense in that situation. Also, if you sold shares to fund the TO, you actually lost total shares by participating, not gaining free warrants like this.
Assuming that is the reason, and they raise enough to get the deal done to reach milestone payments, i.e. no more Paulson, then the only seller remaining would be the note holder, which didn’t seem to be selling today when I looked and they don’t sell millions of shares in such a short span like we have seen over the last week or so.
