The 4-3 board vote mentioned in Pestell's complaint
concerned the naming of Dr Kelly as CSO, it wasn't the vote on Pestell's firing. The 4-3 included a vote cast by Pestell. (I think this is what you were alluding to trding, apologies if not).
We don't know the vote tally for firing Pestell, just that one board member had concerns about firing the face of the cancer program who is also the largest shareholder and a board member. I think if that vote had been close it definitely would have been mentioned in the complaint.
