The "first use in commerce" proof is what I am interested in, as is the USPTO. Kyle claimed it was May 15th. I questioned that date when I first posted the rendering in the application on 8/6, but what do I know? "Allegedly" nothing.

They could call SeaSearcher, aka Tinkerbell 2.0 the KK 2000. That matters not. What matters for IP protection is when it is/was first used in commerce.
I got a feeling they will either ask for extensions regarding the specimen before the 6 months expires in February, or they will submit an "Intent To Use" application, which essentially means it hasn't been used in commerce yet.
How "close" is "close?"
