That's a fair point and I have no problem if that is what is determined. I guess my stance is more that this should be determined by a judge and CytoDyn not let these shares go uncontested given the fact that RP has brought a lawsuit.
IMO CytoDyn should file to exercise the option to purchase the restricted shares. A judge would make a determination whether RP retains voting rights with these shares until the bigger picture is sorted out.
Also, I agree and misstated that RP needs to prove his innocence. CytoDyn needs to prove the 'for cause' reason to terminate RP......but these shares shouldn't just be ignored with a lawsuit now in play and as I understand only a 90 day period to exercise the repurchase option. While it appears on the surface that RP is only requesting $1.3M (likely just based on out of pocket cash from CytoDyn for the salary and pro-rated bonus for this year), IMO these shares make it worth significantly more.....although not direct cash from CytoDyn.
