It's almost as though they are trying to divide church and state (USPTO and SCOTUS or lower court). The US patent office scrutinizes over eligibility for patents and further scrutinizes over them if a review is necessary. The main reason IMO the legal system has become involved is to save an infringing party's money not defend a patent holder.
Our system that was in place worked and provided entrepreneurship a means of sustaining it's legal right to ownership of ideas. The end result of changes made to our legal system, not the patent department, has taken away legal rights of ownership and turned modern ingenuity into a joke. Patent-able ideas and investment go hand in hand and without it the middle class will surely disappear. San Francisco 2.0 on HBO is a classic example of the shape of things to come.
