Concerned about the ENDV " law suit " ? I'm not and never was but here are some additional insights from a knowledgeable observer :


" Just because they listed the SofPulse as a predicate does not mean that it is infringing on any of their patents.

It simply means that they are substantially equivalent not that they are identical. The ActiPatch uses the same frequency but all the other parameters are different, which is why they had to submit clinical data to support the 510k. If it was identical then they would not need clinical data.

I have a degree in EE and biomed engineering, so I understand a lot of the "technical jargon" aka the description of the inventions.

I read the ENDV patents and to me they look like they are either invalid (if they did not list prior art) or they are unenforceable because the BIEL patents were filed earlier and they do not use a "mathematical model" to configure their waveform.

I looked up the attorney and he is not particularly competent in EE and his credentials are on the lower end. I doubt ENDV has the money to really go after someone infringing.

The fact that they would list the 510k in the lawsuit as proof of infringement and willful infringement at that tells me that they have very little to hang on. "
