The defendants were already defeated in court. The company is now merely riding out the mandatory appeals process and trying to "frost the cake" by expediting restitution. The important part is that the preferred and common shares, as well as certain "notes" due, were rendered null and void, and the legal costs associated with pursuing that outcome will not be an issue going forward.
