Off shore brokerages allow shorting of penny stocks - there is a "cash balance" requirement as best as I remember, so a person needs a large trading account which is beyond almost all the penny players.

I have not researched lately.

Similar to off-shore sports betting which existed long before sports betting was allowed in the USA except for Las Vegas.
