Thank you for writing to me about patent law. I appreciate your taking the time to contact me on this important issue.
Innovation is the foundation of America’s economic growth, and fixing our patent system to support American innovators and inventors is one of my top priorities in the Senate. Congress must address abuse in the patent system, but broad changes that undermine the ability of inventors to enforce their patent rights put our entire innovation economy at risk.
That’s why I introduced the STRONG Patents Act, which takes a series of focused, targeted steps to make the patent system work for individual inventors and research-intensive companies from every sector of the economy. It targets harmful patent trolls without risking broader, unintended negative consequences to every legitimate investor, inventor, and patent holder in our entire system. My bill includes provisions to end abusive demand letters and raise the pleading standard for patent plaintiffs to match all other forms of civil litigation. These changes are critical to addressing the legitimate concerns of end-users while maintaining our vibrant and diverse innovation economy.
A strong patent system is one of the critical ways we distinguish ourselves from competing economies around the world, and we cannot afford to rush into passing a bill that would further weaken our innovation economy. The consequences of not protecting patent holders from abuse is significant: we risk undermining our nation’s ability to invest in high-risk ventures and break new ground in our fights against diseases from Alzheimer’s to Multiple Sclerosis. I will continue building support for smart, targeted patent reform.
