It's not an infringement as far as I know because it's not a beverage as described in our trademark registration. It may actually help us if anything because it's temporary and it's getting the name in the news.

Even though not our product, the name is one that sticks on the brain easily, and our Rocky Mountain beverages will be hitting store shelves very soon now.

Later we'll probably see Rocky Mountain High beverages getting widespread distribution (once MJ is federally legalized) according to what Doug Gillen said in podcast 22. I wouldn't be surprised to see them extend the coverage to include snacks.
