Mike, you are absolutely correct. Individual states control what is and what is not permitted for sale until Federal regulations are adopted. So since Rite-Aid and GNC operate in most of the states, they could use state legislation to provide products on a state by state basis. They would effectively side-step the Federal regulations. The only problem I see is the labling. They would need to be careful that laws in each state are complied with so as not to get in trouble.
