Only the older, female judge, (who was a research scientist with a PhD before getting a law degree) fully understood the R&G argument by my read of the DC court transcript. Her other two colleagues didn't IMHO. They punted, without written opinion, which might have clearly shown that. So, you're right, R&G should "dumb it down" to the "third grade" level for their next appeal. Can't wait to find out just where & when that will be!
