Dear Judge Falk:
We represent Plaintiff StrikeForce Technologies, Inc. (“StrikeForce”) in the abovereferenced matter, and write on behalf of StrikeForce and Defendants Duo Security Inc. and Centrify Corporation. We submit this letter to provide the Court with the status of the appeal in StrikeForce Technologies, Inc. v. SecureAuth Corporation, Appeal No. 18-1470. Further to our last status letter dated January 22, 2019, on February 19, 2019, the United States Court of Appeals for the Federal Circuit affirmed the district court’s granting of a motion to dismiss finding StrikeForce’s patents invalid under 35 U.S.C. §101. StrikeForce intends to appeal the Federal Circuit’s decision and file a petition for writ of certiorari with the U.S. Supreme Court. Pursuant to this Court’s December 12, 2017 Order Staying Actions, staying the above-referenced matter pending the conclusion of all appeals in the SecureAuth matter (Dkt. No. 125), the present case should remain stayed pending the outcome of the Supreme Court appeal.
