The attorney for KBM sent a letter to the Magistrate. In it they stated they want to discontinue the suit against Veal. And requested that a report and recommendation in favor of a judgment against the company be made. The Magistrate replied that KBM’s application must be made before the District Court in the first instance. Which in this case is the New York Eastern District Court.
If I’m right there should be a motion/application filed by KBM in that court before long which will show up on Pacer.
