The longer the better, I believe has to do with the judges writing opinions on overturning a dismissal/decision.
The longer the decision takes, the more thought given to the decision, some feel that means better chance of winning.
Why? well If you are going to deny an appeal based on lack of evidence that would be easy . Boom! Easy to write "we found your argument unpersuasive and your appeal is denied".
However to overturn a decision requires legal explanation or an opinion for the future of case (patent) it requires the judges to have , in a word , time!. Time to craft a perfect legal opinion for not only the case at hand, but for other future similar cases
At any rate that is my thoughts on the matter. I am not a lawyer. So take it with a grain of sand. Although I do read a lot of legal stuff. And talk to a lot of legal people.
