My thinking was more that they would delay the process, but I suppose they could issue a denial.

I wouldn't be so quick to throw $4500 at anything based on a paid press release. Several of the 10 firms in that piece are defunct or are in poor fiscal health. The press release authors are content creating machines, so I doubt much intelligent research went into it.
It is extremely difficult for small undercapitalized companies in the pharmaceutical and medical device space to survive as a going concern, let alone investors making a profit. My take is this was gambling money on the IP lawsuit. Win some lose some. It is to difficult to find real information on this firm.
