An excellent "bottom-line" assessment on what we might expect regarding the forthcoming decision! The 3-judge panel would be swimming upstream, against the SCOTUS decisions, and the PTAB's authority regarding the patents! I don't think they would be inclined to challenge the SCOTUS guidelines!
