Joe scheduled the CC a couple days after receiving a letter from Alpha’s attorney, so I’ll guess he made a new plan to satisfy their financing needs.
The convertible note deal was a day before the Alpha letter was received. The CC was announced after both, looking at dates in the Sec filings.
