Yeah, I'm going with door #2.
At any point in the legal proceedings thus far any of the defendants lawyers could have raised the same concerns. If there was any credence to what's alleged to be behind door # 1, then the appeals to the convictions would be well along by now for the earliest cases.
And such appeals would be very publicly announced, they would be breaking news.
