NTEK will be suspended as a ticker, investors will be hung out to dry and David Foley will face criminal charges from the DOJ.
The SEC does NOT issue these documents during the investigation period. The SEC only does so once full and final investigations are completed.
They have NTEK, David and his wife locked down on these charges and told him as much in the communication. All of the civil impact aside, the very nature of the charges implies immediate recommendation beyond the civil charges to the DOJ for criminal prosecution.
The issue for NTEK shareholders is suspension of trading coming soon and eventual delisting of the ticker completely.
