members of the board ... Knobbe Martens filed an early motion to dismiss StrikeForce’s complaint on the grounds that the asserted patents were invalid under the Alice 35 U.S.C. § 101. The court granted SecureAuth’s motion and invalidated all 43 asserted claims in StrikeForce’s three asserted patents.
StrikeForce won all challenges to their IP in the PTAB court. This win came in October of 2017 and I was sitting in the StrikeForce office when the call from Ropes and Gray came in telling them of the win. The FACT that they won in the PTAB court should of told the Judge in the SecureAuth Case that the Alice 35 U.S.C. § 101 did not apply to the process of StrikeForce's OOB patent and that the Patent was VALID, but he (the judge) ignored that case and did not even examine the contents of Ropes and Gray's brief. Therefore, all cases currently in the court system were put on hold until this was decided so that it can be settled once and for all ... that the patents are valid and that the Alice 35 U.S.C. § 101 does not apply or all the cases on stay could continue on that possibility. The Case against SecureAuth will go to Oral Argument so that StrikeForce's IP cannot be challenged as patentable and be invalided by a lower court again.
Patent holders know that value of this win and one that I spoke to stated that once StrikeForce wins this case it will be a $$.00 to $$.00 stock over night. No longer will anyone be able to challenge the validity of their Patent and the PTAB Court is backed up by the Supreme Court. We are Golden !!!
