No, what I was refering to in my post was about a post in the fall of 2017.
The agreement you posted today, was initially posted in sept. of 2017. Back then the boards were questioning the funding and how it was to be allocated, spent and repaid (just like some of todays posts). So, a poster contacted Kay (fall 2017) and commented on this board that the litigation financing could be used for anything the company deemed necessary. But, was to be tied to the litigation (hence litigation financing) and only repaid with settlement money.
