I posted a couple of weeks ago that in the critical V, E & G 'Markman' hearing last year where the judge ruled on the validity of SFOR's patents, V, E & G attorney's did try this approach. They lost which is why Vasco & Gemalto filed with the court and asked to stay their 'settlement' negotiations until after the SecureAuth Alice 35/101 case is finished.
And to think...last year's Markman hearing was BEFORE the PTAB ruling as well as the Supreme court ruling.
