I would not breathe a word until SA is a done deal, then the C&D letter could reference the PTAB/SCOTUS decisions in reference to the SA case.

1. Cite their infringement
2. Prove there is no defense for their actions (PTAB)
3. Ask if they would prefer to settle now or later.
