Thanks for the reply... and I understand your point, my thought process is as follows, ACS royalties for OOBA (when added to the 15% for the keystroke) is 5%. After 9/2020 it will be a few more points (around 8%, please check my math). in infringement cases most attorneys shoot for royalties that were not paid and look for lisencing with similar royalties going forward.
So, without treble damages, i expect to see our attorneys are pushing for the royalty rate advertised in ACS agreement of atleast the 5% as per ACS deal. But I would still be thrilled with a lower percentage considering dozens of infringers to follow.
Can't wait to see, but will be happy with even $10M per current infringer.
I dont see a repeat of the MSFT settlement. R&G are going for bigger numbers. IMO.
