The judge should be sighted for unethical behaviour as he has direct family working for the defendant. A case of this magnitude should be scrutinized over with extreme prejudice at this point. Given the prior confirmation of the weight that our utility patents hold it would be a farce IMO to have this case heard by Judge Kronstadt(or whatever his name is) again. From what I understand this isn't the first time he has abused his power but it should be the last.
