Based on past experience listening to Mark's interviews, I think this tweet can be read in more than one way, especially in light of SFOR not actually currently being listed on the November arguments calendar. I don't think his speaking or writing is always fully in sync with his thoughts. The grammar gets weird at times. I've noticed this on several occasions.

Face value take away;
It's on the schedule but might not be.
That is IMO a really unclear message. It seems a bit like these quotes which a lot of people seem to enjoy.

An upbeat interpretation but a big stretch since he doesn't comment on the court;

IMO people will read what they want to read in his tweet, but he does clearly say it's exciting which I liked to see. However I still place my expectations for the appeal to now be heard in December at the earliest, and I will be pleasantly surprised if it comes earlier. Yes my expectations are a moving timeline pushed further out with each month of argument calendaring that doesn't have SFOR on it.
I hope at least people find the Yogi Bear quotes entertaining.
