Cisco just wanted to lock in Duo's client base .... I don't think they spent too much time thinking about the treble damages. They've been in court battles before, and it probably doesn't scare them much. Let's see where it goes from here .... I hope they eventually do get really scared and settle this already, I wanna see how this turns out : )
