You can file whatever you want Jersey, but if a judge sees no new evidence, the judge will deny the request. Simple law at it's best. And, it's the ruling judge's choice to grant or deny. Of course they will "try" to appeal and the judge will look to see the new evidence...if it's not there, it will not be excepted.
And if it wasn't presented earlier, the judge will want a CLEAR explanation of why.
