Agreed, their actions not only financially damages the company, but us, the share holders as well. I have dealt with the business end of the legal system enough to believe that threat of action means nothing to the likes of the idiots over there; legal action is all they will understand. at minimum, a cease and desist needs to take place. Typically, It has to hit them where it counts, in the wallet and public disgrace. Then and probably only then, it may send a strong warning to others who may think about following said behaviour.
