In most cases yes, In this case dont think so, only 1 claim raised against the patent by SA,. and that's Alice 101
When the judges overturn that , what is there left for the lower court to decide?
If there were multiple claims raised , perhaps IMO
But Alice is the whole enchilada presented buy SA counsel!
And Appeal Judges don't like hollow, empty ingredient-less, enchilada's!
