Why has infringers not settled?
It's my opinion that they took it to such length for multiple reasons.
They thought they could circumvent the patent and abuse a small company. Bad advice as MSFT paid a price.
Their legal council gave them false hopes.
They are going to have to pay a huge amount of money that was probably presented as not meaningful to current investors and now it will be!
That being said they already went all in with a full house and SFOR is sitting on a royal flush.
My final guess is they thought they could negotiate better terms in the end in mediation but did not count on a federal court ruling throwing out their total argument. Why should we negotiate now? I see treble damages and ongoing revenue stream!
