I don't think there will be a need to go after Google since DUO is providing SFOR IP to them already. Once DUO settles this year with x3 damages and "future licenses" -- that will clear Google.

I believe Mr. Kay's approach going after companies providing Cyber Security platforms to the ECOSYSTEM first is a brilliant move, therefore requiring less litigation.
