The distressed CE was issued publicly by otc markets as of january 8, 2018, just fyi.
the official notice was sent in a press release in february 8 of that year:

there is no reason i can fathom why any issue would take this long to correct.
as atlas1 stated, ntek is prevented from selling or issuing stock and has been since last year. i thought (along with funding) this set up well for an investment, as ntek could not by law dilute further.
i also thought foolishly that the ce and lawsuits and funding would be sorted long ago. lesson learned i soppose.
