Claiming that having visited the 9/11 memorial justified the MAGA hat as a 'spiritual' expression obviously didn't impress the judge, nor should it have.
Claiming fundamental beliefs as a reason to deny service was tried during the civil rights era. It was routinely misused to maintain separate schools and to deny public accommodations.
