I never read Judge K's opinion, but I have read the SFOR appeal a few times now, and that is exactly what happened to Judge K. He apparently simply did not grasp the concept of the Out-Of-Band portion of the technology. The Federal Circuit Court of Appeals deals with technology all the time. I have great faith they will be able to wrap their heads around SFOR's unique tech and issue an opinion that makes it clear who owns OOB authentication. $SFOR
